Orders and support
Export Compliance Policy
The export checks that apply to an order: destinations, the parties involved, end users and end uses, classifications and licenses, and what happens when an order is held or cancelled.
Sofitrek is based in the United States and conducts transactions subject to applicable United States export-control, sanctions, customs, anti-boycott, and related laws. Other countries' laws may also apply depending on the product, parties, destination, route, and end use.
This policy is a commercial notice, not legal advice or a complete statement of the law.
Orders are subject to review
Sofitrek may review a website order, RFQ, quotation, account, payment, shipment, return, or other transaction for:
- customer, consignee, purchaser, intermediate party, freight forwarder, and ultimate end user;
- destination, routing, transshipment, and diversion risk;
- intended end use and industry;
- denied, restricted, blocked, sanctioned, or otherwise prohibited parties;
- embargoes and destination restrictions;
- military, intelligence, nuclear, missile, chemical, biological, surveillance, or other restricted end uses;
- product classification, license requirements, license exceptions, and documentation;
- unusual payment, identity, address, quantity, or transaction patterns;
- any other fact that creates a reasonable legal or compliance concern.
Screening may occur before quotation, payment, order acceptance, shipment, refund, or another transaction step and may be repeated when facts or lists change.
Information the buyer must provide
The buyer must provide complete, accurate, and current information reasonably requested for compliance review, which may include:
- legal name, address, country, ownership, and business activity;
- purchaser, consignee, intermediate consignee, importer, freight forwarder, and ultimate end user;
- final destination and any planned reexport or transfer;
- specific civilian or other end use;
- product quantity and integration context;
- government authorization, license, exemption, or classification information;
- written end-use or end-user certification.
Sofitrek may decline to proceed when information is incomplete, inconsistent, unverifiable, or creates unresolved concern. Do not use another person's identity, address, payment method, freight forwarder, or destination to avoid review.
Prohibited transactions and diversion
Products must not be exported, reexported, transferred, resold, diverted, or used in violation of applicable law or the written transaction terms.
The buyer must not route a product through an intermediate country or party to conceal the ultimate destination, end user, or end use. The buyer is responsible for controls that apply after delivery, including restrictions on reexport and transfer.
Holds and requests for information
A compliance hold pauses the affected transaction. It is not an accusation and does not necessarily mean the transaction is prohibited.
During a hold, Sofitrek may request additional information, consult current government lists and guidance, seek professional or government input, require a license, change available shipping routes, or decline the transaction. Sofitrek may restrict fulfillment while review is open.
Sofitrek may be unable to disclose how screening works, the details of a match, internal notes, confidential sources, legal advice, or government communications.
Classifications and licenses
A product page may show an ECCN, EAR99, HTS, Schedule B, country-of-origin, or similar field for convenience. Such information may come from a manufacturer, supplier, database, or earlier transaction and may be incomplete or outdated.
Unless Sofitrek expressly confirms a classification for the transaction, the field is informational and is not a binding legal determination. The buyer remains responsible for its own import, export, reexport, transfer, and end-use obligations.
A commonly available commercial component can still require a license or be prohibited because of the destination, end user, end use, quantity, technology, or another transaction fact.
Sanctions and restricted parties
Sofitrek may screen transaction parties and relevant ownership information against government sanctions and restricted-party sources. Potential matches may require additional review and cannot always be resolved from a name alone.
Sofitrek may reject, block, report, or otherwise handle property or a transaction as required by law. No customer instruction can require Sofitrek to proceed with a prohibited transaction.
Freight forwarders and reshippers
Use of a freight forwarder, consolidator, export agent, or reshipper does not remove the requirement to disclose the ultimate destination, consignee, end user, and end use. Sofitrek may decline a forwarding arrangement that creates unresolved diversion, documentation, carrier, payment, or sanctions risk.
Order acceptance and cancellation
Payment does not override compliance review and does not guarantee order acceptance. Sofitrek may place inventory on hold while review is pending.
Sofitrek may decline or cancel all or part of a transaction when:
- law prohibits or restricts the transaction;
- a required authorization is unavailable or not verified;
- a party, owner, destination, end user, or end use cannot be cleared;
- the requested routing creates unacceptable diversion risk;
- information is false, incomplete, inconsistent, or not provided;
- a carrier, payment provider, government authority, or applicable rule prevents the transaction;
- proceeding would create an unacceptable legal or regulatory risk.
When legally permitted, Sofitrek will provide a general explanation that the order could not proceed for export, sanctions, destination, party, end-user, end-use, licensing, or compliance reasons.
Refunds for cancelled unshipped orders
When Sofitrek cancels an unshipped order or line for a compliance reason, Sofitrek will approve a refund of the amount paid for the cancelled unshipped quantity to the original payment method, subject to the Refund Policy.
A refund does not establish that the transaction was permitted and does not require Sofitrek to accept a replacement order using different information or routing.
Recordkeeping and cooperation
Sofitrek may retain transaction, screening, classification, license, communication, and fulfillment records for the period required or reasonably necessary for compliance, audits, investigations, disputes, and legal obligations.
Buyers must preserve records and cooperate with lawful end-use checks, government requests, and license conditions that apply to their role.
